Implications of national and state cultural and linguistic standards for Asian and Pacific Islander communities

Cultural and linguistic barriers to accessing health and social services are among the top concerns facing many immigrants, including Asian and Pacific Islanders (APIs). In California, 16% of the population overall is limited-English proficient (LEP). However, 43% of Asians and 17% of Pacific Islander populations do not speak English very well.

Federal and state laws and standards have been introduced and reinforced to guarantee access to services for LEP individuals. The Office of Civil Rights issued a policy guidance regarding services for LEP persons. National Standards on Culturally and Linguistically Appropriate Services (CLAS) provide guidelines for health care organizations and providers. California law requires state agencies to make services accessible to LEP individuals, and California’s Medicaid and SCHIP plans incorporate requirements in their contract language to ensure LEP access.

These national and state standards are improving access to services. Government agencies are collaborating more with community based organizations in program development, outreach, and education. There is greater emphasis on developing relationships and networks at the local, state, and national levels. Most importantly, the needs of LEP individuals are finally being addressed.

However, there is still more that needs to be done. We must provide: a clear grievance process and enforcement mechanisms for the laws and standards that have been developed; funding sources to ensure interpretation and translation; data collection efforts that target the health status and utilization of LEP individuals; education for consumers and providers regarding their rights and responsibilities in working together to achieve positive health outcomes.
