Regulating second trimester abortion out of existence

This paper examines current efforts to limit access specifically to second trimester abortion and the public support for such regulation. Included in the paper is a discussion of the use of health care regulations know as Targeted Regulations of Abortion Providers (TRAP) laws as a means to make provision of care so cumbersome as to be impossible. An analysis is given of differing state laws which affect provision of second trimester abortion care. The specific case of the potential that Mississippi's only abortion clinic would not be able to provide second trimester abortion is reviewed to illustrate the detrimental effect of second trimester abortion regulations on providers. The paper also explores other means for regulating second trimester abortion including the banning of so-called “partial birth abortions,” the ban on abortions in public hospitals, and the requirements that women be informed about the scientifically inaccurate existence of fetal pain. In addition the paper explores the paradoxical use of women's health “safety” as a justification for the abortion regulation which simultaneously limit access to hospital-based care and emergency support services. Finally, the paper examines current public opinion on second trimester abortion and the popular support for restricted access to such care. Strategies for reframing the need for expanded access to second trimester care to redress the low levels of support are provided.
