Starting at the local level: Passing smokefree legislation from the ground up

On July 24, 2003, the New York State Public Health law was strengthened. From that day on, smoking was banned in all workplaces including bars, restaurants and bowling alleys. One research study showed that within three months of implementation, hospitality workers' exposure to secondhand smoke dramatically decreased. Another study indicated that the law has not financially harmed restaurants and bars as initially feared. In Dutchess County, support for the law continues to be strong. According to a 2005 survey, Dutchess County, out of eight counties included in the survey, had the lowest percentage reporting indoor smoking in bars. Residents are nearly unanimous in viewing secondhand smoke as dangerous. Dutchess County was instrumental in keeping the issue of smokefree places in the forefront. Prior to the statewide legislation, the local Board of Health passed a smokefree regulation and despite its eventual reversal, was able to keep the issue as a priority for community discussion. The Dutchess County Legislature soon after passed a law that prohibited smoking in all places with the exception of stand-alone bars. This prompted the NY State Restaurant Association to actively advocate to the NY State Legislature for a “level playing field” which was for a 100% smokefree workplace law. This presentation will focus on the importance of local activity in passing statewide smokefree legislation and will cover lessons learned and challenges in implementation and enforcement.
