169898 Limitation on Tobacco Control in Chinese LegislationMonday, October 27, 2008
This paper mainly concentrates on the tobacco control legislation in China dealing with the public health issues. In the first part, the paper overviewed Chinese tobacco market situation and relevant public health problem. Second, the paper point out two limitations in the Chinese legislation about liability of tobacco producers and wholesalers to common people, when they are involved in a public health lawsuit. Third, the paper analyses the original reasons of these two limitations. At last, the paper discussed and analyses the first public will lawsuit against tobacco factory and wholesalers in China. With the case analysis, the paper dropped the conclusion that under the Framework Convention on Tobacco Control, Chinese legislation should definite, and regulate the liability of tobacco producers and wholesaler to common people where there is public health lawsuit and demand of compensation.
