The advent of HIPAA (Health Information Portability and Accountability Act) has heightened the awareness of how personally identifiable health information is managed by schools. FERPA (Family Education Rights Privacy Act) has received increased scrutiny and many information sharing practices and interagency agreements are being reexamined in this new climate of student and family privacy. Until recently, much of the focus in practice changes and policy has been on providers sharing information with schools and schools sharing student health information with primary care providers and acute and ambulatory health agencies. Recent federal memorandums have highlighted and prohibited common practices of sharing student health information with state agencies and between state agencies. This session will outline recent clarifications in federal law and implications for common practices. Specific areas requiring changes in policies and practices will be outlined.
