School Health Information Privacy Issues; FERPA
This session is designed to give an overview of consent and privacy issues related to school-based interventions. An explanation of FERPA regulations will be presented with conflicts between FERPA and state reporting guidelines. Also, the differences between FERPA and HIPAA will be addressed. Specific issues related to parental notification for BMI screening and the value of informed passive parental consent versus active written parental consent will also be presented.
Learning Objectives: At the conclusion of the session, the participant (learner) in this session will be able to: 1. Identify confilcits between FERPA regulations and state reporting guidelines 2. Understand conflicts and inconsistencies between FERPA and HIPAA 3. Understand challenges of a school-based BMI screening and parental notification. 4. Recognize the differences in obtaining active written parental consent and conducting pasive informed consent for school-based interventions.
