Although employer-based coverage has not received as much attention as the Exchanges in discussions of the ACA, it remains the foundation of our health coverage system. The employer responsibility penalties under the ACA are intended to ensure businesses maintain adequate, affordable job-based coverage or pay their fair share for public coverage. The ACA poses opportunities and risks for job-based coverage especially for low-wage, part-time and seasonal workforces. Unions are greatly invested in the future of job-based coverage as well as the success of the ACA and face a number of critical decisions as the ACA is implemented.
